Florida Supreme Court considers ‘camera-on’ amendment to remote depositions rule

by Beau Blumberg | Aug 26, 2025 | News And Articles

The Florida Supreme Court is considering a proposal to amend a rule governing remote depositions to address concerns about witness coaching and other misconduct. The proposed amendment to Rule 2.530 (Remote Technology) would require the deponent, their attorney, and the questioning attorney to be visible at all times during a remote deposition unless all parties agree otherwise or the court orders an exception.

Reasons for the Amendment

  • Preventing Misconduct: The proposal, stemming from a referral by the Civil Procedure Rules Committee, aims to prevent “bad behavior” like witness coaching that can occur in remote proceedings without a judge present.

  • Ensuring Integrity of the Record: The Florida Court Reporters Association (FCRA) supports the amendment, noting it will help uphold the integrity of the legal process. They cited a case where a defendant was found to be texting instructions to another during a virtual arbitration, which ultimately led to the ruling being vacated.

  • Assisting Court Reporters: The FCRA also stated that being able to see participants helps court reporters create an accurate record, as they rely on visual cues (like speechreading) to accurately transcribe testimony, especially with multiple participants or heavily accented speakers.

Broader Concerns

The article also highlights a larger debate about the increase in remote proceedings. While remote technology offers new efficiencies, some legal professionals, like former Florida Bar President Edward Blumberg, worry that a heavy reliance on it could stunt the professional development of younger lawyers who miss out on vital in-person courtroom experience. The article concludes by suggesting a hybrid system that balances the benefits of virtual proceedings with the traditional, in-person legal world.
